On Tuesday 20 December 2022, at 10:00 am, the Court of Appeal of The Hague will issue its judgment in the so called ‘turbo expedited’ appeal procedure between the Dutch Council for Refugees (VWN) and the State and the COA. The State and the COA have appealed against the decision of the preliminary relief judge of the District Court of The Hague on 6 October 2022. Subsequently VWN also lodged an appeal. In the judgment of 6 October 2022, the court obliged the State and the COA, among other things, to adhere to the minimum standards for asylum reception. The request for suspension regarding the enforceability of the judgment of the State and the COA was rejected by the Court of Appeal on 17 October 2022.
The ruling can be followed online via a livestream of the Court of Appeal: https://streams.nfgd.nl/uitspraak-hoger-beroep-zaak-vluchtelingenwerk-versus-staat-en-coa
The Dutch Council for Refugees is assisted in this case by lawyers Tom de Boer and Thomas van der Sommen.
